We at Neugart GmbH take the protection of your personal information seriously. The protection of your privacy when surveying, handling and using your personal data is very important to us which we take into account for our business processes with high regard and considering the legal requirements. Personal data

Should the opportunity arise for visitors of the website to enter personal or business-related data (title, name, email address, company name, address), the user releases this data on a purely voluntary basis. The use and payment of all offered services are permitted – if technically possible – without divulging any personal data or disclosing anonymous data or an alias.

Personal data is used to achieve the business purpose or else to establish business contacts and notify customers. As a matter of principle, this data is not disclosed without the customer’s consent. Our customers’ private data is not sold to third parties, nor is it marketed elsewhere. We sincerely promise that we only collect, utilize and apply the data provided by our customers for the purposes mentioned above.

Personal data is required for the full use of our Tec Data Finder (CAD download area). This data is collected solely for internal purposes and is stored using a cookie in our customer database. Information on personal data is also required to provide informational material (e.g. dimension sheets) or to answer individual questions. Furthermore, we only store and use personal data provided voluntarily by you.

 

Compatibility

Our website has been optimized for the latest browser versions of Internet Explorer/Mozilla Firefox/Google Chrome/iOS Safari. The 3D product animations have been rendered in Web GL format. Chrome or Safari are recommended browsers for the unrestricted use of this format. The website has been optimized for mobile devices like tablets or smartphones. 

 

Integration of services and third-party content

It may be the case that third party content from other websites is integrated on this website, such as videos from YouTube, Google Maps map data or content from other websites. This always assumes that the provider of such content (hereinafter referred to as a „third party provider") has access to the IP address of the user. Without the IP address, the content cannot be sent to that user’s browser. The IP address is therefore required to present this content. We strive to use only content whose corresponding providers use the IP address only for the transmission of content. However, we have no control over whether the third party provider stores the IP address, for example, for statistical purposes. We inform users of this when we are aware of it.

 

Newsletter

If you would like to receive our newsletter, we require a valid email address as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive this newsletter. No additional data is collected. We only use this data to send the information requested and do not disclose it to third parties.

You may revoke consent to the storage of your data and email address as well as their use for sending the newsletter at any time, for example, by clicking the “Unsubscribe” link in the newsletter.

 

Matomo

We have integrated the Matomo component of the provider InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand, on this website. Matomo is a software tool for web analysis, i.e. for collecting, collating and evaluating data about the behavior of visitors to websites. Among other things, data is collected about the website from which a data subject has accessed a website (so-called referrer), which subpages of the website have been accessed or how often and for how long a subpage has been viewed. This is used to optimize the website and for cost-benefit analysis of Internet advertising.

The software is operated on the server of the controller, the data protection sensitive log files are stored exclusively on this server. Matomo sets a cookie on your IT system. By setting the cookie, we are enabled to analyze the use of our website. Each time one of the individual pages of this website is called up, the Internet browser on your IT system is automatically prompted by the Matomo component to transmit data to our server for the purpose of online analysis. As part of this technical procedure, we obtain knowledge of personal data, such as the IP address of the person concerned, which we use, among other things, to trace the origin of visitors and clicks.

By using the cookie, personal information, for example the access time, the location from which an access originated and the frequency of visits to our website are stored. Each time you visit our website, this personal data, including the IP address of the Internet connection you are using, is transmitted to our server. This personal data is stored by us. We do not pass on this personal data to third parties.

These processing operations are carried out exclusively when explicit consent is given in accordance with Art. 6 (1) lit. a DS-GVO.

Server log files

Our website provider independently collects and stores information that your browser automatically transmits to us in so-called server log files. This includes:

This data is not stored in such a way as to be personally identifiable. This data is not compiled with other data sources. We reserve the right to retrospectively examine this log data in the event of concrete evidence of illegal activity.

If your information is also processed in countries outside of the EU in exceptional cases (i.e. in so-called third countries), this takes place if you have given your express consent for this, or it is necessary so that we can provide you with our services, or it is prescribed by law (Art. 49 GDPR). Furthermore, processing of your information in third countries only takes place if certain measures have been taken to ensure that an appropriate level of data protection is being provided (e.g. adequacy decision by the EU commission or so-called suitable guarantees, Art. 44 et seq. Storage / Deletion of data

Tax-related data is stored for 10 years after the termination of the business relationship and non-tax related data is stored for 6 years. User data of the license is stored for 2 years after expiration of the used license and then destroyed in compliance with data protection.

Processing and scope of data processing (customer and contract information)

On our web site and as part of the use of the login area of our Tec Data Finder (TDF) online configuration tool, we offer users the opportunity to register by providing personal information in order to independently configure a gearbox/motor combination and then request CAD models, technical data sheets and a quote. When doing this, the information is entered into an input screen during one-off registration without a user account or when a user account is created, and is stored and used by us.

A name must be entered, the use of pseudonyms is not possible. We use the so-called double opt-in procedure to activate your user account, i.e. Your registration is not complete until you have confirmed your registration beforehand by clicking on the link contained within a confirmation email that has been sent to you for this purpose. If your confirmation is not received promptly, your registration will be automatically deleted from our database.

 

Data transmission in the event of contract conclusion for services and digital content

We only transmit personal information to third parties if this is necessary within the scope of the CAD models and technical data sheets and the request for a quote, i.e. to sales partners who assist you on site.

Service providers who are granted the technical permission to do so can also examine the information that you provided during registration. These service providers are order processing companies in some cases. Appropriate order processing contracts have been agreed to for this.

Any other transmission of the information does not take place, or only if you have given your express permission for the transmission. The forwarding of your information to third parties for the purpose of advertising, for example, will not take place without your express consent.

The following data is collected as part of the registration process:

  • Registration (company address, first name and last name, department, email address, phone number)
  • User account (password entry)
  • Acceptance of the privacy statement and the usage conditions

The following information is also stored when registration takes place:

  • IP address of user and host name of computer used for access
  • Time of service inquiry
  • Browser type / browser version
  • Operating system used
  • Referrer URL

 

Legal basis for the data processing

The legal basis for the processing of the information is the consent of the user as per Art. 6, Para. 1, Item a of the DSGVO (General Data Protection Regulation). If the registration is used to fulfill a contract or carry out pre-contractual measures, it is an additional legal basis for the processing of the information as per Art. 6, Para. 1, Item b of the DSGVO. Within the scope of statistical evaluation, information is also processed on the basis of Art. 6, Para. 1, Item f of the DSGVO.

 

Purpose of the data processing

Our Tec Data Finder (TDF) online configuration tool can be accessed and used with restricted functionality without registering. If you would like to use the TDF as a registered user in order to obtain CAD models and technical data sheets with motor adaptation, request quotes for gearboxes or track your account activities, you can use the login data of your activated user account or register as a new user.

For important changes such as to the scope of the order or if technical changes are required within the scope of your configuration, we will notify you using the e-mail address or phone number that was specified during one-off registration without a user account or when a user account was created.

If you activate your user account, you will also receive information about our training program. 

Your information is also stored for internal system-related and statistical purposes.

 

Duration of storage

The information is deleted as soon as it is no longer needed to achieve the purpose for which it was collected. As far as the information that was collected during registration is concerned, this is the case if the registration on our web site has been removed or modified.

For the data that is collected for fulfilling a contract (e.g. usage agreement for the provision and purchase of CAD models and technical data sheets) or for carrying out pre-contractual measures, and if the information is no longer required to fulfill the contract, even after the conclusion of the contract, it may be necessary to store the contract partner's personal information in order to fulfill contractual or legal obligations.

Information which you enter during one-off registration without a user account is used for two years after it has been made available. Your personal information is then deleted. Deletion of your information that was entered during one-off registration without a user account can also be requested at any time before the deletion period has elapsed.

The processing is carried out in accordance with Article 6 (1b) EU-DSGVO - the contractual relationship between Neugart GmbH and your company, as well as in the context of our legitimate interest to advise your company regarding your service request.

  • Provision of the service of contacting our customer service by our customers.

 

Deletion deadlines

Your entered, personal data as our customer contact, will be stored by Neugart GmbH according to § 147 AO for 10 years.
 

 

 


Purpose of data processing

When contacting Neugart via the Online Service for the purpose of having a quote prepared by us, personal data will be collected and processed. In the following, we would like to inform you about the nature and extent of data processing by us (Neugart GmbH).

The Online Service is an online tool that provides product information and other functions for Neugart products in digital form. This includes, among other things, a request function for replacement gearboxes or accessories. The user enters personal data in a contact form. A quote is then addressed to the user. Contact can also be made for consultation purposes (e.g. in case of ambiguity).

 

What data is processed?

When you use the request service, we process the following personal data (mandatory data):

  • Address of company
  • Salutation, first name and last name 
  • E-mail address
  • Phone

Any other information you provide is voluntary, but will enable our Sales & Customer Service to provide you with the best possible advice. Data processing for new contacts applies for the data collected in the request function for replacement gearboxes or accessories.

Participants in the customer satisfaction survey

Customer satisfaction is a very important aspect of quality for our organization. We conduct customer satisfaction surveys in order to assess whether our products and services meet the needs and expectations of our customers.

Participation in the customer satisfaction survey is voluntary. It is necessary to provide your personal data to participate in the survey; it is not possible to participate in the survey without providing this information.

 

Transmission of data on conclusion of the contract for services and digital content

To send invitation e-mails and handle the technical aspects of conducting the customer satisfaction survey, we use service providers who process your data in accordance with our instructions (so-called "data processors"). At the data processor, only the employees responsible for conducting the survey have access to your data.

For this reason, please contact us directly if you have technical or content-related questions. No other transfer of information occurs unless we have received your express permission to do so. There are no plans to transfer or process your data in countries outside the EU.

The following data is collected as part of the customer satisfaction survey:

  • Registration (company address, first and last name, e-mail address)
  • Acceptance of the privacy policy

For technical reasons, certain data is collected in the course of conducting customer satisfaction surveys. When you open a page of the online survey, our service provider’s web servers automatically record the following in a log file:

  • the IP address of your computer,
  • the address (URL) of the page that was opened,
  • date and time the page was opened,
  • any error messages and,
  • if necessary, the operating system and
  • the browser software used on your device

We use the log file data solely to ensure the functionality of our services ( e.g. error analysis, assurance of the system's security and protection against misuse); this data is deleted after 90 days. We do not link log file data with your name, your e-mail address or your responses.

 

Legal basis for the data processing

The legal basis for processing the information is your agreement pursuant to Art. 6, par.1, item a of Germany's General Data Protection Regulation (DSGVO).

In other cases, the legal basis for using your contact data for the online survey is our justified interest in the related surveys for the purpose of optimizing our products and services, for statistical evaluations and for market research, Art. 6, par. 1, item f of the DSGVO.

Insofar as log file data needs to be qualified as personal data in individual cases, the legal basis for processing the log file data is our justified interests (their analysis, assurance of the system's security and protection against misuse), Art. 6, par. 1, item f of the DSGVO.

 

Purpose of the data processing

We use your name and your e-mail address to send you an invitation to participate in a customer satisfaction survey. You will find a general link to the survey in the e-mail. During the survey, we record your responses to the individual questions. Participation in the survey is voluntary, as is answering the individual questions.

In addition, we use the collected data for the purpose of optimizing our products and services, for statistical evaluations and for market research.

 

Retention period

The survey results are saved to your customer data.

The information is deleted as soon as it is no longer needed for the purpose it was collected. With regard to the information collected during the customer satisfaction survey, this is the case after two years have elapsed.

Your personal information is then deleted. Deletion of your data that was entered during the one-time registration in the absence of a user account can also be requested at any time prior to expiration of the retention period.

 

 


For what purposes and on what legal basis do we process personal data? 

We process personal data about you for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis for this is Section 26 (1) in conjunction with (8) sentence 2 BDSG. Furthermore, we may process personal data about you insofar as this is necessary for the defense of asserted legal claims against us arising from the application process. The legal basis for this is Art. 6 Para. 1, Letter f DSGVO, the legitimate interest is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG).

 

What categories of personal data do we process? 

We process data related to your application. This may be general personal data (such as name, address and contact details), information on your professional qualifications and school education or information on further professional training as well as data on health or other information that you provide to us in connection with your application.

 

What are the categories of recipients data? 

We may transfer your personal data to companies affiliated with us, insofar as this is permissible within the framework of the purposes and legal bases set out in Section 3. Furthermore, personal data is processed on our behalf on the basis of contracts in accordance with Art. 28 DSGVO, in particular by host providers or providers of applicant management systems. 

 

Is the transfer to a third country intended?

A transfer to a third country is not intended.

 

How long will your data be stored? 

We store your personal data for as long as is necessary for the decision on your application. Insofar as an employment relationship between you and us does not come about, we may also continue to store data insofar as this is necessary for the defense against possible legal claims. In this case, the application documents are deleted 6 months after notification of the rejection decision, unless longer storage is required due to legal disputes. 

 

Necessity of providing personal data

The provision of personal data is neither legally nor contractually required, nor are you obliged to provide the personal data. However, the provision of personal data is required for the conclusion of a contract for employment with us. This means that if you do not provide us with personal data when applying for a job, we will not enter into an employment relationship with you.

 

No automated decision making 

There is no automated decision in individual cases within the meaning of Art. 22 DSGVO, which means that the decision about your application is not based exclusively on automated processing.

 




Right to information

With the right to information (Art. 15 DSGVO), you are given a comprehensive insight into the data relating to you and other important criteria such as the purpose of processing or the duration of storage. The exceptions to these rights regulated in section 34 of the BDSG (German Federal Data Protection Act) apply.

 

Right to correction

The right to correction (Art. 16 DSGVO) includes the possibility of having incorrect personal information corrected.

 

Right to deletion

The right to deletion (Art. 17 DSGVO) includes the possibility of having information deleted by the responsible authority. However, this is only possible if your personal information is no longer needed, has been processed illegally or consent with regard to this has been revoked. The exceptions to these rights regulated in section 35 of the BDSG (German Federal Data Protection Act) apply.

 

Right to restriction of processing

The right to restrict processing (Art. 18 DSGVO) includes the possibility of preventing further processing of the personal information you provided for the time being. A restriction particularly occurs during the checking phase of other rights by the affected party.

 

Right to data portability

The right to data portability (Art. 20 DSGVO) includes the possibility of the party concerned receiving his/her personal information in a normal machine-readable format from the party responsible in order have it forwarded to another responsible party if necessary. In accordance with Art. 20 Para 3 Clause 2 of the DSGVO, these rights are not available if the data processing is required for performing official functions. This is only the case at Neugart GmbH if the personal information is being processed for fiscal purposes.

 

Right to object

The right to object (Art. 21 DSGVO) includes the possibility of disagreeing with the further processing of your personal information in a special situation, insofar as this is justified by the performance of official functions or public or private interests.
